Basis of Agreement

This User Content Agreement, along with our Terms of Use, outlines the terms and conditions applicable to you when you access any interactive features on our website, upload content, engage with other users, or share links on our site.

Misrepresents your identity, status, or any affiliations you have with third parties.

Contradicts the terms of any court order.
Is defamatory, disparaging, rude, or insulting towards any person or organization, or could harm the reputation of any individual or entity.
Contains or refers to sexually explicit material, or redirects users to such content.
Incites, encourages, or promotes any illegal activity, or assists anyone in planning or executing illegal acts.
Contains statements that could be interpreted as encouraging or inducing acts of hatred, violence, or terrorism.

Actions We May Take Regarding Uploaded Content

We reserve the right to take any appropriate action in response to suspected or actual violations of this User Content Agreement. Such actions may include:

Issuing a warning regarding your non-compliance with the terms of this User Content Agreement.
Suspending or terminating, without notice, your access to our website.
Modifying or removing any content you have uploaded.
Disclosing your identity to any third party who files a complaint regarding your uploaded content, particularly if that content appears to violate their or any other person’s intellectual property rights, privacy rights, or other rights.
Sharing your identity, uploaded content, and any relevant information with law enforcement if we deem it reasonable or necessary, or as required by law.
Initiating legal proceedings against you for any expenses incurred due to your breach of this User Content Agreement.
Taking any other additional actions we consider appropriate under the circumstances.

YOU HEREBY AGREE TO HOLD US HARMLESS AND INDEMNIFY US AGAINST ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, REPUTATION, OR GOODWILL, AND ANY OTHER CONSEQUENTIAL LOSSES), PENALTIES, COSTS (INCLUDING PROFESSIONAL AND LEGAL FEES ON A FULL INDEMNITY BASIS), AND EXPENSES INCURRED BY US AS A RESULT OF ANY BREACH BY YOU OF THIS USER CONTENT AGREEMENT OR OUR TERMS OF USE, OR ANY ACTION RESULTING FROM CONTENT YOU UPLOAD (INCLUDING, WITHOUT LIMITATION, ANY DEFAMATORY CONTENT).
We will not be liable to you for any consequences resulting from our actions taken in response to any breaches of this User Content Agreement, our website terms of use, or any other applicable documents, laws, or regulations governing your use of our website.

No Responsibility for User-Generated Content

Some sections of our website may include content and materials uploaded by other users. Such content is either owned by or licensed to the users who uploaded it, or it is owned by third parties, and it has not been approved by us. Severance

If modification is not feasible, that term will be removed. If a term is defective only due to a partial provision, that part alone will be deleted. You may not assign, transfer, or otherwise handle any of your rights and obligations under this User Content Agreement.

Waiver

Any failure or delay by us in exercising any of our rights or remedies under this User Content Agreement shall not be interpreted as a waiver of those rights or remedies or any other rights we may have against you or any other person. The exercise of any rights or remedies will not restrict our ability to further exercise those rights or remedies at any time.

Third-Party Rights

Except as explicitly provided in this User Content Agreement, no individual or entity other than a party to this agreement shall have any rights or remedies regarding this User Content Agreement, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

Reservation of Rights

The rights and remedies available under this User Content Agreement are in addition to any rights and remedies available under law.

Governing Law and Jurisdiction

This User Content Agreement, along with any referenced documents, and any disputes arising from it, whether contractual or otherwise, shall be governed by and construed in accordance with Austrian law.
The courts of Austria will have exclusive jurisdiction over any claims or disputes arising from or related to this User Content Agreement or any referenced documents.
